Payment Terms and Conditions

1. Definitions

In these Terms and Conditions:

  • "ISM" refers to the International School of Music Turramurra.

  • "Customer" refers to the parent, guardian, or individual responsible for payment of invoices issued by ISM.

  • "Pre-Approved Payment Arrangement" refers to the Customer’s authorisation for ISM to process payments automatically via the nominated payment method.

  • "Payment Processor" refers to Pinch Payments or any other third-party payment provider engaged by ISM.

2. Acceptance of Terms

By electing to participate in the Pre-Approved Payment Arrangement and by continuing to engage ISM’s services, the Customer acknowledges and agrees to be bound by these Terms and Conditions.

3. Payment of Fees

3.1. ISM issues invoices for term fees and any additional charges (including but not limited to books, materials, and concert participation fees) via email in advance of each term.

3.2. All invoices must be paid in full within fourteen (14) days of the date of issue unless otherwise agreed in writing by ISM.

3.3. Payments will be processed automatically through the Customer’s nominated payment method under the Pre-Approved Payment Arrangement, in accordance with the invoice due date.

3.4. The Customer authorises ISM and its Payment Processor to debit all amounts payable under this agreement, including applicable surcharges and late payment fees, from the nominated account or payment method.

4. Transaction Surcharges

4.1. ISM reserves the right to pass on transaction fees charged by the Payment Processor. These surcharges will be clearly disclosed on each invoice.

4.2. By agreeing to these Terms and Conditions, the Customer accepts responsibility for all applicable transaction surcharges associated with automated payments.

5. Late Payment and Default

5.1. Any amounts outstanding beyond the payment due date will incur a late payment surcharge of five percent (5%) of the overdue amount.

5.2. If the Customer fails to pay any outstanding amounts, ISM reserves the right to:
a) Suspend or terminate the provision of lessons and services;
b) Refer the outstanding debt to a debt collection agency, with any associated costs and recovery fees being payable by the Customer;
c) Withhold future enrolments or participation in ISM activities until outstanding balances are settled in full.

6. Refunds and Cancellations

6.1. ISM operates a no-refund policy for missed lessons.

6.2. For private lessons, the Customer may reschedule one (1) lesson per term with a minimum of twenty-four (24) hours' notice, subject to teacher availability.

6.3. Group class make-up lessons may be offered within the same week if another class at the same level is available. ISM makes no guarantee regarding availability.

6.4. Should the Customer wish to discontinue lessons, a minimum of four (4) weeks’ written notice is required. Failure to provide notice will result in continued billing for the notice period.

7. Amendments to Pre-Approved Payment Arrangement

7.1. The Customer may cancel or amend their Pre-Approved Payment Arrangement at any time by providing ISM with at least fourteen (14) days’ written notice.

7.2. ISM reserves the right to amend these Terms and Conditions at its sole discretion. Any changes will be communicated to the Customer via email and will take effect immediately unless otherwise stated.

8. Data Security and Privacy

8.1. ISM and its Payment Processor will take all reasonable steps to protect the Customer’s payment information in accordance with applicable Australian Privacy Laws and Payment Card Industry Data Security Standards (PCI DSS).

8.2. ISM does not store any credit card or bank account details directly. All payment information is securely managed by the Payment Processor.

9. Limitation of Liability

9.1. To the maximum extent permitted by law, ISM shall not be liable for any loss, damage, or inconvenience arising directly or indirectly from the use of the Pre-Approved Payment Arrangement, including but not limited to failed transactions, incorrect payment processing, or service suspension due to non-payment.

9.2. The Customer acknowledges that the use of third-party Payment Processors is at their own risk, and ISM makes no representations or warranties regarding the services provided by such Payment Processors.

10. Governing Law and Jurisdiction

10.1. These Terms and Conditions are governed by the laws of the State of New South Wales, Australia.

10.2. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales.

By accepting these Terms and Conditions, you authorise the International School of Music Turramurra to process payments as outlined above and acknowledge that you have read, understood, and agree to these terms.
